CITY COUNCIL ACTION LETTER
CITY OF LEE’S SUMMIT

Thursday, December 19, 2013


REGULAR SESSION NO. 39
6:15 P.M.  Mayor Rhoads called Regular Session No. 39 to order.

City Manager Steve Arbo and Acting City Attorney Rich Wood were also present.

APPROVAL OF AGENDA:  On motion of Councilmember  Whitley, second by Mayor Pro Tem Gray , the Council voted unanimously to approve the published amended agenda.

1.    PUBLIC COMMENTS:    There were no Public Comments.


2.    COUNCIL COMMENTS:   There were no Council Comments.


3.    APPROVAL OF CONSENT AGENDA:
COUNCIL ACTION: On motion of Councilmember Whitley, second by Mayor Pro Tem Gray, the Council voted unanimously to approve the Consent Agenda as follows:

A.    MAYOR’S APPOINTMENTS:
Board of Adjustments: Reappoint William Wilson and Joe Towns, terms to expire 12-17-18.
Health Care Foundation of Greater Kansas City: Reappoint Diane Seif, term to expire 12-31-16.

B.    ENVIRONMENT AND NATURAL RESOURCES COMMITTEE: Approval to temporarily relocate the North Recycling Center to the east side of the Lee's Summit Municipal Airport during Lee's Summit Road construction activities in the summer of 2014.
Note: This item was considered by the Environment and Natural Resource Committee on December 2, 2013.

4.    PROPOSED ORDINANCES:
The following proposed ordinances, submitted as bills, are often passed with little or no discussion.  All items were previously discussed by the Council or Council Committee.  This is a formal reading of proposed ordinances, as required by the City Charter.

A.    BILL NO. 13-138 AN ORDINANCE ACCEPTING FINAL PLAT ENTITLED “THE PADDOCK AT RICHARDSON RANCH, 8TH PLAT, LOTS 279-286 & TRACTS A & B”, AS A SUBDIVISION TO THE CITY OF LEE’S SUMMIT, MISSOURI.
COUNCIL ACTION:  On motion of Councilmember Johnson, second by Mayor Pro Tem Gray, the Council voted unanimously to approve and numbered ORDINANCE NO. 7408.

B.    BILL NO. 13-139 AN ORDINANCE CALLING FOR AN ELECTION TO AUTHORIZE GENERAL OBLIGATION BONDS FOR THE CITY OF LEE'S SUMMIT, MISSOURI.
COUNCIL ACTION:  On motion of Councilmember Holland, second by Mayor Pro Tem Gray, the Council voted unanimously to approve and numbered ORDINANCE NO. 7409.


5.    ORDINANCES – PREVIOUS PUBLIC HEARING:
The following proposed ordinances, submitted as bills, are passed with little or no discussion, as staff was directed by City Council, after a public hearing on the matter, to draft the proposed ordinance.  No additional public comments are heard regarding these bills.  This is a formal reading of proposed ordinances, as required by the City Charter.

A.    BILL NO. 13-140 AN ORDINANCE APPROVING THE SECOND AMENDMENT TO THE EAST U.S. 50 HIGHWAY CORRIDOR IMPROVEMENT TAX INCREMENT FINANCING PLAN.
COUNCIL ACTION:  On motion of Councilmember Whitley, second by Mayor Pro Tem Gray, the Council voted unanimously to approve and numbered ORDINANCE NO. 7410.


6.    PRESENTATIONS:

A.    Presentation on the Crime Reduction Team (CRT)
COUNCIL ACTION:  No Council Action Required.

B.    Government Finance Officers Association (GFOA) Budget Award
COUNCIL ACTION:  No Council Action Required.


7.    PUBLIC HEARINGS (Sworn):
In an effort to assist applicants who travel from outside the Kansas City Metropolitan Area, every effort will be made to hear the application on the scheduled meeting date.  

A.    SPECIAL USE PERMIT for automobile sales – Capital Motors, 1703 NE Rice Rd; Capital Motors, LLC, applicant. (Appl. #13-131)
COUNCIL ACTION:  On motion of Councilmember Whitley, second by Councilmember Johnson, the Council unanimously to direct staff to PRESENT AN ORDINANCE approving Appl. #PL2013-131 - Special Use Permit for automobile sales – Capital Motors, 1703 NE Rice Rd; Capital Motors, LLC, applicant, subject to staff’s letter dated December 11, 2013, noting the 3 recommendations.




8.    OTHER BUSINESS:

A.    BILL NO. 13-141 AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR AUTOMOBILE SALES IN DISTRICT CP-2 ON LAND LOCATED AT 1703 NE RICE ROAD FOR A PERIOD OF TEN (10) YEARS, ALL IN ACCORDANCE WITH ARTICLE 10 WITHIN THE UNIFIED DEVELOPMENT ORDINANCE, FOR THE CITY OF LEE'S SUMMIT, MISSOURI.
COUNCIL ACTION:  On motion of Councilmember Cockrell, second by Councilmember Mosby, the Council voted unanimously to approve and numbered ORDINANCE NO. 7411.

B.    Presentation and Request from Downtown Lee's Summit Main Street regarding the proposed Downtown Lee's Summit Community Improvement District (CID).
COUNCIL ACTION:  On motion of Councilmember Cockrell, second by Councilmember Mosby, the Council voted unanimously to direct staff to DRAFT AN ORDINANCE authorizing the Mayor to execute the Downtown Lee's Summit Community Improvement District on behalf of the City.

C.    Presentation from RED Development regarding a Potential Request to Amend the Summit Fair Tax Increment Financing (TIF) Plan to Support the Development of Summit Place Shopping Center.
COUNCIL ACTION:  Moved to Ordinance.

1)    BILL NO. 13-142 AN ORDINANCE APPROVING A TAX INCREMENT FINANCING FUNDING AGREEMENT FOR A POTENTIAL AMENDMENT TO THE SUMMIT FAIR TAX INCREMENT FINANCING PLAN AND AUTHORIZING THE CITY MANAGER TO EXECUTE SAID AGREEMENT ON BEHALF OF THE CITY.
COUNCIL ACTION:  On motion of Councilmember Mayor Pro Tem Gray, second by Councilmember Cockrell , the Council voted 6 “Aye”, 2 “No” (Councilmembers Mosby and Whitley) to approve and numbered ORDINANCE NO. 7412.

D.    Consideration of a Lease Agreement between the City of Lee’s Summit and the Lee’s Summit Historical Society for use of the WPA Post Office Building as a Historical Museum.
COUNCIL ACTION:  On motion of Councilmember  Mosby, second by Mayor Pro Tem Gray, the Council voted unanimously to direct staff to prepare an ordinance to be presented to City Council for consideration of a Lease Agreement between the City of Lee’s Summit and the Lee’s Summit Historical Society for the purpose of housing the Historical Society of Lee’s Summit Museum in the WPA Post Office located at 220 SW Main in Lee’s Summit, Missouri.



9.    COMMITTEE REPORTS:  No Committee Reports.


10.     COUNCIL ROUNDTABLE:   

    Councilmember Cockrell would like to review changing the date of the fiscal year to fall in line with the federal fiscal year and how that would impact improvements. He suggested this go before the Finance Committee.
    Councilmember Johnson agreed with looking at changing the fiscal year dates but suggest this should be reviewed by the Budget Committee.
    Councilmember Binney would like to have an inspection done on the WPA Post Office building to determine the possible upkeep and maintenance costs the City is liable for over the next 25 years.
    Mayor Pro Tem Gray as Mr. Darren Fristoe, Assistant City Administrator, to give a brief report on the search for City Attorney.
    Mr. Fristoe advised the City had received 31 resumes and the resume filing deadline would be open until December 31, 2013.  
    Mayor Rhoads reminded everyone the next Council meeting date will be January 9, 2014.




11.    STAFF ROUNDTABLE:    There was no Staff Roundtable.

ADJOURNMENT:  There being no further business, Mayor Rhoads ADJOURNED the December 19, 2013, Regular City Council meeting at 9:05 p.m.
