CALL TO ORDER
Mayor Rhoads called the July 21, 2016, Regular Session No. 7 to order at 6:15 p.m.

APPROVAL OF AGENDA

Mayor Rhoads advised that Item No. 4A. BILL NO. 16-149, was to be continued to August 4, 2016. On motion of Councilmember Binney, second by Councilmember Forte, the Council voted unanimously by voice vote to APPROVE the agenda AS AMENDED.

1. PUBLIC COMMENTS:

Ms. Susan Coffman, 306 NE Corder, pointed out the achievements of different Councilmembers, which demonstrated their altruistic nature. She knew there are good people on the Council.

Mr. Steve Lathrop wanted to know if the Mayor Pro Tem performed background checks on Councilmembers when assigning them to committees. Councilmember Binney replied during Council Comments.

Ms. Marian Zajic, 604 NW Ashley, was appalled at the way this Council has been run for the last month or so. She felt the business of the City was not being conducted because of the antics of a few councilmembers.

2. COUNCIL COMMENTS:

In answer to the question from Mr. Lathrop during Public Comments, Mr. Binney explained he spent between two and three-and-a-half weeks meeting with each councilmember before presenting appointments to Council committee and liaison positions. He found a way for senior members to be in a leadership role but also allowed new members to gain experience.

Councilmembers Faith and Moreno voice their appreciation to Ms. Coffman for her comments. Councilmember Forte read a text from her granddaughter regarding recent events on the Council. Councilmember Carlyle stated the Council must work as one body and that one person should not take credit for the work of the whole Council. A Council fighting itself does nothing but destroy the body.

3. APPROVAL OF CONSENT AGENDA:

A. 2016-0383 Mayor's Appointments:
Arts Council: Reappoint Kathryn Salek, term to expire 7-22-19.

A motion was made by Councilmember Binney, seconded by Councilmember Carlyle, that this Appointment be approved. The motion carried unanimously.

4. PROPOSED ORDINANCES:

A. BILL NO.   16-149
AN ORDINANCE ACCEPTING FINAL PLAT ENTITLED “THE RESERVE AT STONEY CREEK 2ND PLAT, LOTS 54-59 & TRACT K”, AS A SUBDIVISION TO THE CITY OF LEE’S SUMMIT, MISSOURI.

This item was CONTINUED to August 4, 2016, per approval of the agenda.

B. BILL NO.   16-150
AN ORDINANCE ACCEPTING FINAL PLAT ENTITLED “EAGLE CREEK, 14TH PLAT, LOTS 617-660 AND TRACT N“, AS A SUBDIVISION TO THE CITY OF LEE’S SUMMIT, MISSOURI.

ACTION: A motion was made by Councilmember Faith, seconded by Councilmember Seif, that Bill No. 16-150 be adopted and numbered Ordinance No. 7923. The motion carried by the following vote:

AN ORDINANCE APPROVING A PRELIMINARY DEVELOPMENT PLAN ON LAND LOCATED AT 120 SW M-150 HWY, IN DISTRICT CP-2, PROPOSED QUIKTRIP, ALL IN ACCORDANCE WITH THE PROVISIONS OF UNIFIED DEVELOPMENT ORDINANCE, NO. 5209, FOR THE CITY OF LEE'S SUMMIT, MISSOURI AND REPEALING ORDINANCE NO. 7914 PASSED BY THE COUNCIL OF THE CITY OF LEE’S SUMMIT, MISSOURI ON THE 7TH DAY OF JULY 2016.

ACTION: A motion was made by Councilmember Forte, seconded by Councilmember Carlyle, that this Ordinance be adopted and numbered Ord. No. 7924 The motion carried by the following vote:

AN ORDINANCE AUTHORIZING THE EXECUTION OF A SOLE SOURCE AGREEMENT WITH TELVENT USA LLC, FOR THE SOFTWARE SUPPORT AND MAINTENANCE OF THE SCADA OASYS DNA SYSTEM IN THE AMOUNT OF $37,647.44 FOR THE FIRST YEAR, WITH TWO POSSIBLE ONE YEAR RENEWAL OPTIONS FOR THE WATER UTILITIES OPERATIONS DEPARTMENT.

ACTION: A motion was made by Councilmember Seif, seconded by Councilmember Carlyle, that Bill No. 16-152 be adopted and numbered Ordinance No. 7925. The motion carried by the following vote:

AN ORDINANCE APPROVING THE SURETY BOND DEPOSIT AGREEMENT GUARANTEEING INSTALLATION OF SUBDIVISION IMPROVEMENTS FOR THE EAGLE CREEK, FOURTENTH PLAT, LOTS 617-660 SUBDIVISION BY AND BETWEEN THE CITY OF LEE'S SUMMIT, MISSOURI AND HUNT MIDWEST, AND APPROVING THE USE OF A SURETY BOND AS SECURITY FOR THE INSTALLATION AND CONSTRUCTION OF SAID SUBDIVISION IMPROVEMENTS.

ACTION: A motion was made by Councilmember Edson, seconded by Councilmember Seif, that Bill No. 16-153 be adopted and numbered Ordinance No. 7926. The motion carried by the following vote:

5. PRESENTATIONS:

A. 2016-0384 Presentation of Conceptual Master Development Plan for 50 Highway and M-291 area associated with the current Administrative Delay.

Mr. Bob McKay, Director of Planning and Codes Administration, reported on the Master Plan for the 50 Highway and M-291 area. The Council's Administrative Delay, expiring October 1st, was approved to allow planning around the new 50 Highway and M-291 South interchange. Mr. McKay displayed renderings of potential development in this area and a time schedule for consideration of a City-initiated rezoning and a new fire station.

Councilmember Seif would prefer to see the Community and Economic Development Committee review this plan. There was a consensus from the five members present at the dais (Councilmembers Forte, Carlyle, Binney "Away From the Table") to forward this to the CEDC, instead of the full Council. The recommendation from the Planning Commission would come back to the full Council.

This Presentation was referred to the Community and Economic Development Committee.

B. 2016-0388 Overview and Status Report of the Summit Place Development and TIF project.

Mr. David Bushek with Gilmore and Bell reported on the progress for the Summit Place Development and TIF project. The TIF Act requires approval within ten years after the plan was initially approved. This is an absolute deadline. If the project is not approved, the TIF cannot be used for that project.

The two bills before the Council were initially read for the first time in 2014, so only a second reading is necessary at this time.

This Report was read into the record.

C. 2016-0391 Out-of-State Motor Vehicle Sales Tax Presentation

Mr. Conrad Lamb, Finance Director, provided background information on the proposed ballot question for the August 2nd election, regarding Sales Tax on Motor Vehicles.

6. OTHER BUSINESS:

A. BILL NO.   14-29
AN ORDINANCE APPROVING REDEVELOPMENT PROJECT 2A FOR THE LEE’S SUMMIT EAST AMENDED AND RESTATED TAX INCREMENT FINANCING PLAN AS AMENDED BY THE FIRST AMENDMENT AND ACTIVATING THE COLLECTION OF TAX INCREMENT FINANCING REVENUES THEREIN.

(NOTE: First reading of this proposed ordinance was on May 14, 2014.)

ACTION: A motion was made by Councilmember Binney, seconded by Councilmember Carlyle, that Bill No. 14-29 be adopted and numbered Ordinance No. 7927. The motion carried by the following vote:

7. COMMITTEE REPORTS (Committee chairs report on matters held in  Committee):

Councilmember Forte reported the next CEDC meeting will be August 10th. Also, the first Communications Committee meeting will be August 8th at 4:00 p.m.

Councilmember Faith advised the PSAB met on July 19th. He appreciated members of the Fire and Police departments but also noted the work of the dispatchers, who are the first contact in emergencies.

8. COUNCIL ROUNDTABLE:

Councilmember Binney warned people playing Pokeman Go! to please stay off the railroad tracks.

Councilmember Binney appreciated the meeting held by Chief Forbes and Councilmember Forte for residents in a subdivision where an unfortunate shooting incident occurred over the weekend. Bringing neighbors together after the incident was a good step.

9. STAFF ROUNDTABLE:

Mr. Arbo presented a recommendation, in the spirit of continual improvement, to hire an outside auditing firm to provide a performance audit on best management practices and purchasing processes, including all City and Parks departments. This audit would be in addition to the annual financial audit. If the performance audit found areas of concern, these concerns could be turned over to the financial auditing firm. He would expect the auditor to bring back a comprehensive set of procedures on how to purchase. The Council reached a consensus to proceed.

10. ADJOURNMENT

There being no further business, the July 21, 2016, City Council Regular Session No. 7 was ADJOURNED at 8:20 p.m.
