Lee's Summit Appoints Special Prosecutor for Smith Assault Cases

Attorney Eric Butkovich, Assistant Prosecutor in Blue Springs, has been appointed to serve as special prosecutor in Lee’s Summit Municipal Court to litigate assault charges against two well-known Lee’s Summit men. Seventy-year-old John M. Smith was arrested at a Lee’s Summit West High School football game on October 15, 2010 for assaulting a 17-year-old male student. Smith was handcuffed and transported to the Police Department that evening. After further investigation, a ticket for assault was also issued to Smith’s son, 45-year-old Mark A. Smith, and mailed to him. Melissa Fears, Lee’s Summit’s Public Communications Coordinator, said a special prosecutor was appointed to avoid a “conflict of interest.” Although Fears did not go into details about the possible conflict, both Smiths are well-known in the city. John M. Smith is a retired LSPD officer, a former city council member and previous mayoral candidate. Mark A. Smith, vice-president of a local insurance agency, had filed as a candidate for city council last April, but later withdrew.
The initial trial date for both Smiths was December 15. Their hearings were continued for the second time on Wednesday of this week. They are due back in municipal court on April 20. Each Smith has hired a personal attorney.
