Lee’s Summit Mayor Randy Rhoads issues statement about White vs. McKinley case

On July 8, 2010, we publicly stated our concerns regarding the recent court award of $14 Million plus attorney’s fees to Ted White. The court’s decision was against a former employee, Richard McKinley, who was found to have violated the constitutional rights of Mr. White. Anyone who is involved in the legal system understands that any outcome may be possible and that there is no certainty until a final judgment has been ordered. This case was between Ted White and Richard McKinley; the City of Lee’s Summit was not a party in the case. We did not want to interfere with the court proceedings on this matter until they had been fully completed.
Since we have made our public announcement, many Lee’s Summit citizens have asked why the City is not making the payment to Ted White. As Mayor and City Council, we are responsible for the proper use of taxpayer dollars. It is clear to us that we are restricted by our local ordinance and State law from making this payment on behalf of our former employee. We are obligated to make certain that any payment made to Ted White is legally correct and that the City of Lee’s Summit is legally obligated to make the payment. Any effort to not make certain that these conditions exist would be poor fiscal management.
We would ask our citizens to remain patient during this difficult period of time. We understand that citizens are receiving a lot of public information from Ted White and his legal team. Clearly they are interested in creating some type of “public pressure” to force the Mayor and City Council into making a decision that is not legally permitted at this time.
Please know that we will make certain our decisions are legally defensible and will fulfill any and all legal obligations, should they exist, to Mr. White in the future.

Dear Lee Summit cizitens,
I feel there was a possible crime committed by either this current mayor Mr. Rhoads or the previous mayor before him. Willful blindness is a federal crime in my profession as a banker. If I committed such an act I would serve federal prison time. I feel that willful blindness took place between mayors(s), city manager and the city attorney. I would think as citizens of this wonderful community that you would want this investigated. Someone knew this ordinance was in place (TIME LINE) and willfully turned the other cheek. The city signed a contract to pay damages awarded and thus someone knew this ordinance was in place. Do the mayor and city council think we or you are stupid. Also why would you enter a contract fraudualantly if you knew this was on books? I guess my point is laws are made by lawyers for lawyers and NOT THE PEOPLE! You as tax payers are going to continue to pay the attorneys who wrote these laws, signed off on contracts and ordinances for the city. The attorneys are gettting your money not the victim of injustice. This was a sly trick poney show by attorneys representing the city and just like what happenened in Lee Summit is happening today in this country and they GET AWAY WITH IT!!!
ASK FOR INVESTIGATION!!!!!!! This mayor can't be trusted!!!!
This city council can't be trusted!!!! Someone needs to file complaint with Missouri Bar regarding misrepresentation by city attorney or attorney representing city in this civil matter!!! All it takes is someone to go online and file complaint!!

Mr. Mayor, with all due respect, your statement, "This case was between Ted White and Richard McKinley; Lee's Summit was not a party to this case" is misleading. The City of Lee's Summit and the Chief of Police were defendants in Ted's law suit, and were dismissed out of the case in exchange for the city's promise to pay the judgment. Had the city's internal affairs "investigation" been a real investigation and not a complete whitewash, the facts would have been on the table for the first jury, Ted would have been acquitted, and he would not have spent a day in jail. Had the city been a party to the law suit, and had the details of the city's complicity in McKinley's perjury and misconduct been presented to the jury, the verdict could easily have been millions more. The council unanimously voted to settle the law suit because it believed the agreement was in the city's best interest, and that was probably a correct analysis. Since the city reaped the benefit of the agreement, it should honor its obligations.
Mayor Rhoads is not telling the truth. He knows that, until 2006, the City of Lee's Summit was a defendant in Ted White's lawsuit, along with Richard and Tina McKinley, and Chief of Police Kenneth Conlee. The City is listed as one of the "Defendants that conspired to violate" Ted White's civil rights per 42 U.S.C. para. 1983" which was passed in 1871 to stop the Ku Klux Klan from killing people! At the CITY"S request, the indemnification agreement was signed by Ted, Chief Conlee, Streve Lewis as "authorized by and on behalf of the City of Lee's Summit" and the president and CEO of MARCIT, the insurance company in August of 2006.
This lawsuit was all ABOUT the violation of Ted White's constitutional rights under the color of law. It should worry every citizen in Lee's Summit that you have a mayor and city council that believes they can pass laws that allow the city to ignore the Constitution AND YOUR constitutional rights!

Truly unreal that adult human beings... claiming to have integrity, representing the citizens of Lee's Summit, act as if they have an obligation to protect the very people they supposedly represent, by showing that they are above the law... and blaming these very citizens for not being able to pay up ON A CONTRACT that is SIGNED by the city in order to stay out of the civil suit!!! I have personally read this contract and personally seen the signatures... available to the public... and STILL this OBVIOUSLY ARROGANT Mayer Randy Rhoads doesn't give a damn! Hey Randy... HOW ABOUT SIMPLY HONORING YOUR SITY'S LEGAL RESPONSIBILITY TO PAY YOUR LEGAL AND BINDING DEBT UNDER YOUR OWN CONTRACT!!!??? How do you sleep at night???
Remember... Randy... this is COSTING your own citizens of Lee's Summit $867 per day plus attorney fees to waste time fighting what you're going to lose!!! If I was a citizen of Lee's Summit...
